Digital Millennium Copyright Act

INTRODUCTION

LANGTAIL.COM s.r.o., ID No. 19868987, with its registered seat at Záhřebská 562/41, Vinohrady, 120 00 Prague 2, the Czech Republic, file No. C 393016 maintained by the Municipal Court in Prague ("LANGTAIL") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (the "DMCA"), LANGTAIL's policy provides for the investigation and removal of materials that infringe on the copyright of others.

DMCA TAKEDOWN NOTICE

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright and you believe that any copyright infringements are taking place on or through the LANGTAIL's services ("Services"), please provide LANGTAIL's Designated Copyright Agent with DMCA Notice of Alleged Infringement ("Takedown Notice") containing all of the following information:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit LANGTAIL to locate the material.

4. Information reasonably sufficient to permit LANGTAIL to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

5. The following statement: "I have a good faith belief that the use of the copyrighted material I am complaining of is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use).

6. The following statement: "The information in this notice is accurate and, under penalty of perjury, I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right that is allegedly infringed".

The Takedown Notice should be send to LANGTAIL's Designated Copyright Agent ("Copyright Agent"):

Upon receipt of the Takedown Notice, LANGTAIL shall review your Takedown Notice and:

1. if the Takedown Notice doesn't satisfy the DMCA requirements, LANGTAIL shall request a revised submission; or

2. take whatever action LANGTAIL deem appropriate under the DMCA, including the removal of the challenged content from the Services. Furthermore, LANGTAIL may, in appropriate circumstances, disable access or terminate the account(s) of the reported user(s).

DMCA COUNTER NOTICE

The owner of the allegedly infringing content may submit a DMCA Counter-Notice to the Copyright Agent ("Counter-Notice").

The Counter-Notice must comply with the requirements of the DMCA, and must include all of the following:

1. Your name, title (if acting as an agent), physical address, email address, and phone number.

2. A reasonable identification of the material that has been removed or to which access has been blocked, including any URLs or other identifying information that can help locate the material on the Services before it was removed.

3. The following statement under Perjury: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled".

4. One of following statements (as appropriate):
If you are based in the United States: "I consent to the jurisdiction of the Federal District Court for the judicial district in which my provided address is located".
If based outside of the United States: "I consent to the jurisdiction of any District Court for the judicial district in in which LANGTAIL is headquartered."

5. The following statement: "I will accept service of process from the person who provided the original notification or an agent of such person".

6. An electronic or physical signature of the owner of the copyright or the person authorized to act on the owner's behalf.

LANGTAIL shall review the Counter-Notice, and:

1. if the Counter-Notice doesn't satisfy the DMCA requirements, LANGTAIL shall request a revised submission; or

2. if the Counter-Notice is complete and valid, LANGTAIL shall forward the Counter-Notice to the person who filed the original Takedown Notice, advising that the challenged content will be reinstated within 10 business days, unless LANGTAIL receives a notification that the copyright owner is seeking a court order regarding this matter.
